ACC Files Brief in Australian Cyberattack Privilege Case

ACC Position:

ACC and its Australia chapter requested to file an amicus brief in the case of Glencore v. Commissioner of Taxation for the Commonwealth of Australia. Following the leak of privileged documents from the Appleby law firm in the 2017 Paradise Papers, the Australian Tax Office has sought to use privileged documents of Glencore, a global mining conglomerate, to assess tax and penalties against the company. ACC argues the Australian Tax Office should not be allowed to use privileged documents obtained through a cyberattack on a law firm against Glencore.
