ACC’s Employment and Labor Law Committee (ELLC), in a letter dated November 20, registers several concerns with the Equal Employment Opportunity Commission’s (EEOC) proposed regulations implementing the Americans with Disabilities Act Amendments Act of 2008 (ADAAA). The proposed regulations were published in the Federal Register on September 23.
ELLC lists areas in which companies would like more clarification and other areas that ELLC argues go beyond the intent of Congress. ELLC also states that the EEOC, in its proposed regulations, also included portions of the ADA Restoration Act of 2007, which was rejected by Congress.
