ACC Files Amicus on Application of Crime-Fraud Exception in New Jersey


ACC Position: 

In July, ACC filed an amicus brief in the New Jersey Appellate Division in Sampson v. 3M Company, on the application of the crime-fraud exception to the attorney-client privilege. ACC took no position on the merits of the underlying privilege claim but contended that the crime-fraud exception must be meticulously applied to ensure that privileged communications are not improperly disclosed. This July brief follows a December 2017 amicus brief in the New Jersey Supreme Court, urging the Court to allow an interlocutory appeal of the trial court’s ruling that the documents were subject to the crime-fraud exception.
